These Terms and Conditions govern your access to and use of CanDecide's services, website, and software.


Account Registration and Use

By registering an account with an email address and password, creating a project, and subscribing to our base plan, you agree to comply with these Terms. CanDecide allows you to customize your experience by selecting and integrating various features as per your project requirements. Account and project settings can be managed through the designated settings pages.


Acceptable Use Policy

You agree not to use CanDecide's services for any illegal purposes or in a way that harms or disrupts the service or any user. Our pricing model is based on usage, with specific rates applied per item per month. Users are billed monthly for their usage, with no upper limits imposed on service consumption.


Fees and Payments

Our services are subscription-based with credits provided per subscription and additional credits able to be purchased. Features use credits which varies but can be found on a feature page and will be outlined in your usage report at the end of the month.


Data Ownership and Use Rights

Data collected and stored by CanDecide remains the property of our users. CanDecide provides the tools and dashboard for data analysis and presentation but does not claim any rights over the data itself. Users are granted access to use CanDecide's dashboard and services without rights to the software.


Third-Party Integrations

CanDecide supports extensive third-party integrations, enabling users to ingest events from services like Stripe and to link with external APIs for enhanced functionality. Our platform acts as a conduit for data, standardizing external data formats for use within CanDecide.


Termination and Suspension

CanDecide reserves the right to terminate or suspend access to our services for breach of these Terms, illegal activities, or actions detrimental to our services or users. Users may appeal decisions by contacting us on our support page.


Disclaimers and Limitation of Liability

CanDecide provides its services "as is" without any warranties. We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services. Data is backed up periodically, but users are encouraged to maintain their backups.


Indemnification

Users agree to indemnify, defend, and hold harmless Candecide, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to their account (including negligent or wrongful conduct) by them or any other person accessing the site using their Internet account.


Dispute Resolution

These Terms are governed by UK law. We aim to resolve disputes amicably. Further disputes subject to these terms may require legal resolution, although we strive to avoid such scenarios.


Responsibilities Among Parties

Organizational Clients' Responsibilities:

  • Data Control and Customer Interaction: Organizational clients, as the data controllers, are solely responsible for the data they collect and process through CanDecide's services. This responsibility includes ensuring lawful collection, use, and protection of their customers' data, obtaining necessary consents, and adhering to applicable data protection laws.
  • Customer Support and Disputes: Organizational clients are responsible for addressing their customers' inquiries, support requests, and disputes directly related to the services or products they offer.

CanDecide's Responsibilities:

  • Service Provision to Organizational Clients: CanDecide is responsible for providing the SaaS platform and associated services to organizational clients in accordance with these Terms and Conditions and any other service agreements. Responsibilities include ensuring the platform's availability, functionality, and security as outlined in our service commitments.
  • Data Processor Role: In relation to personal data processed on behalf of organizational clients, CanDecide acts as a data processor. We process data strictly according to our clients' instructions and in compliance with our Data Processing Agreement (DPA) and applicable laws.

End-User Acknowledgment:

  • Relationship with Organizational Clients: End-users acknowledge that their relationship regarding the data collected, and services provided through CanDecide's platform, is primarily with the organizational client. Any questions, requests, or concerns related to personal data should be directed to the respective organizational client.

Liability:

  • Distinct Liabilities: Each party – CanDecide, organizational clients, and end-users – is responsible for its legal and regulatory obligations. CanDecide will not be liable for any breaches of laws, regulations, or rights in relation to end-users' data by organizational clients. Similarly, organizational clients are responsible for any legal and regulatory obligations toward their end-users, including data protection and privacy.

Amendments to Terms

CanDecide may update these Terms periodically. Continued use of our services after such changes constitutes acceptance of the new Terms.
